Just in: The chief judge of the Guantanamo war court, Col. Lanny Acosta Jr., filed notice today that he’s retiring from the Army on Sept. 30. He has been chief since July 1, 2021 -- and is the third Army colonel in a row to hold the slot until retirement. Judge Acosta is presiding in the USS Cole bombing case, which will not reach trial before he leaves. He has scheduled more pretrial testimony next month at Guantanamo on whether he'll admit hearsay evidence. See my article on that thorny question here. https://lnkd.in/er4ZP-45 Col. Acosta wrote in today's two-paragraph notice: "I have not and do not intend to seek post-retirement employment from any Executive Branch agency or other entity associated with the Military Commissions that could cause an appearance of a conflict of interest..." Those of you who have been following Guantanamo's USS Cole case will recognize this issue. An earlier judge, Air Force Col. Vance Spath, secretly pursued and obtained a job from the Justice Department, a conflict of interest that upended more than two years of progress toward the death-penalty trial.

Has Col. Vance Spath been held accountable for his pursuing and obtaining a job from the Justice Department, “a conflict of interest that upended more than two years of progress toward the death-penalty trial.” If so, how has he been sanctioned or punished. If not, why has he not been held accountable? Kevin Manson, Disabled Vietnam Veteran and former Interrogations Officer.
