The Act provides recurring funding for housing very-low to moderate income households. In addition to a multitude of new programs, incentives, and opportunities, this legislation works to focus Florida’s housing strategy in ways that make housing more attainable while streamlining, to some extent, the local approval processes to allow for the same. For instance, the Act mandates that a local government authorize the development of multifamily rentals on sites that are zoned as mixed-use residential, commercial or industrial if at least 40 percent of the residential units in a proposed multifamily development will, for a period of at least 30 years, be affordable to individuals making up to 120 percent of the local area median income (AMI). Because there will now be opportunities to develop residential housing projects in areas that otherwise may have developed with more intense uses, site assessments completed on these properties should be completed with a change of use in mind. A group of civil rights organizations, including the North Carolina State Conference of the NAACP, the Lawyers’ Committee for Civil Rights Under Law, and the Southern Coalition for Social Justice, have filed a motion to intervene in a lawsuit by the Republican Party. The lawsuit seeks to deem 225,000 registered voters in North Carolina ineligible to vote due to missing Social Security numbers and driver's licenses. The lawsuit, filed by the Republican National Committee, alleges that the North Carolina State Board of Elections allowed over a quarter million people to register to vote with registration forms that failed to collect required identification information. The RNC claims that this violation of the federal Help America Vote Act could lead to ineligible voters, including possible non-citizens, on the voter rolls. However, the NAACP and other organizations argue that this lawsuit would disproportionately affect Black voters, as many of them may not have the required documents. The NAACP's associate director, Sailor Jones, is directly affected by the lawsuit, as he would be deemed ineligible to vote if it prevails. The East Carolina University Center for Survey Research released a poll on September 3, which showed Republican Presidential candidate Donald Trump in a one-point lead against Vice President Kamala Harris, the Democratic Presidential candidate. The NAACP and other organizations argue that the lawsuit is a desperate move by the Republican Party to restrict voting rights, while others argue that it is a way to ensure the integrity of the electoral process. #SCOTUS recently overturned 40 years of precedent and fundamentally changed the way courts review federal agency action. Clean Slate Virginia
Beginning in July 2021, Virginia introduced a transformative legal option for handling criminal cases, known as “Deferred Disposition.” This provision, codified under Virginia Code Section 19.2-298.02, offers a unique pathway for both prosecution and defense to work towards a case dismissal or a reduced charge without a formal conviction, provided there is mutual agreement. This development not only enhances the legal toolkit available to attorneys but also serves as a significant step toward aligning Virginia’s judicial processes with those of other states, emphasizing rehabilitation over punishment for certain offenses. The U.S. Supreme Court’s landmark decision to significantly curtail federal regulatory agencies’ power has triggered a fresh round of uncertainty about the status of mj rescheduling. But none of this uncertainty is expected to disrupt the Biden administration’s rescheduling process, policy and administrative law experts told MJBizDaily. The court on Friday ruled 6-3 along partisan lines that courts no longer must give deference to federal agencies’ interpretation of laws when Congress leaves ambiguity, marking an end to the so-called Chevron doctrine, named for a 1984 court case.
