How does a potential ban on US employee non-competes impact a UK/EU company’s US expansion plans?   The US Federal Trade Commission recently proposed a prohibition on non-compete covenants. For UK/EU companies considering US expansion, here are the main takeaways:    1. This is only a proposed rule. It’s not (yet) law and it likely will be some time before any changes come into effect.    2. For now, employers should continue to take into account the patchwork of different US state non-compete laws. Non-competes can be used in some states; in California and a few others non-competes are already severely limited or banned.   3. Employers should think about other ways to protect their businesses in the US, including through appropriate confidentiality, trade secret, IP and non-solicit provisions in their contracts.   For more insight on this important US development, here’s an overview from Wilson Sonsini Goodrich & Rosati: https://lnkd.in/e5FGvfq2
