All else being equal, would you hire a mediator who is still practicing law, or a lawyer who now exclusively mediates? This is the “market survey” question I asked many Toronto litigators back in 2018 when I opened my mediation practice alongside my civil litigation practice. I was surprised that about 95 per cent replied they would prefer to hire a mediator who is no longer practising law. Reasons the litigators provided included: preference for a mediator who has committed to honing their mediation knowledge and skills as opposed to practising mediation, “off the side of their desk”; feeling that a well-developed mediation mindset does not easily co-exist within someone still calling upon their litigation skills; and reluctance to hire a mediator (who necessarily becomes privy to negotiation and advocacy tactics) who may later be faced as opposing counsel. For these reasons, and the fact that I found mediation work intensely rewarding, I decided in 2019 to devote my practice entirely to mediation. I suspect your 2018 survey results (i.e., 95% prefer a mediator who is no longer practicing law) would be the same today. Perhaps its easier to explain to clients why a respected "full time mediator" (or a retired judge) is worthy of spending money for as a mediator rather than "just another lawyer"?

I agree Jennifer - and I believe your market survey responses would also apply to non contentious transactional lawyers who make the move to full time mediation. Great to hear it’s going well for you full time mediating

The result of that survey do not surprise me. It was the response that I received from most clients when I told them about my venturing into the field of mediation as a mediator. As one senior partner said to me... "We want to hire a full time mediator... not someone who is just dabbing in mediation when time allows.... which one are you going to be?" Very soon after I hung up my wig and gown for the last time. Thanks for sharing Jennifer Egsgard
