𝐅𝐚𝐦𝐢𝐥𝐲 𝐃𝐢𝐬𝐩𝐮𝐭𝐞𝐬: 𝐓𝐡𝐞 𝐈𝐧𝐯𝐢𝐬𝐢𝐛𝐥𝐞 𝐓𝐡𝐫𝐞𝐚𝐭 𝐭𝐨 𝟖𝟎–𝟗𝟎% 𝐨𝐟 𝐀𝐫𝐚𝐛 𝐁𝐮𝐬𝐢𝐧𝐞𝐬𝐬𝐞𝐬 At Dubai Arbitration Week, our Partner Abdallah El Shehaby, FCIArb delivered the opening note at the ICC Arbitration session on “Preserving Legacy Through Effective Dispute Resolution: Arbitration & Family Businesses in the GCC.” With his extensive experience advising family businesses and resolving complex shareholder disputes, he highlighted a reality that rarely receives the attention it deserves: * Family-owned businesses represent 80–90% of companies in the Arab world. * They employ 60–70% of the private-sector workforce. * Yet 70% fail to transition to the second generation, and over 90% do not reach the third. * The leading cause isn’t economic pressure but it’s family disputes. What makes these disputes uniquely complex is that they rarely start in the boardroom. They often begin in childhood, in old rivalries, unspoken comparisons, competition for attention, or even the small incidents we tend to dismiss: “You broke my toy.” “You took my candy.” “You were always the favorite.” These moments echo decades later in board decisions, succession plans, voting rights, and control battles. When unresolved, these emotional layers grow into governance gaps, mistrust, and fractured communication, ultimately placing entire multigenerational enterprises at risk.
