Business, construction, commercial collections and real estate litigation. I have worked in-house for four major corporations, and been in private practice since 1997. I have seen the business litigation process from the prospective of corporate management, and as a private attorney. I represent businesses, banks, contractors, land owners and individuals. I handle issues that range from breach of contract, shareholder litigation, real estate title and quiet title actions, and non-compete agreements to RICO and fraud claims.
I understand how companies make (or avoid) decisions. I am a strong proponent of mediation to resolve litigation, but I will try a case when necessary.
When a party litigates, it places the decision in the hands of people (jury) or a person (judge) that knows nothing about his business, circumstances, or interests. When a party settles a case, at least the parties have made their own decisions.
The vast majority of business litigation is contract based litigation. Contracts are the vehicles that drive business. Written contracts are those imperfect documents that record each parties agreements, allocate the risk between the parties, and set forth the rules of the relationship. Verbal contract are perfectly legal, but the details of the agreements are remembered very differently by each party.
Contract and real estate litigation is plentiful. The subject matter of contract disputes is as varied as are the types and number of businesses. I represent parties as both plaintiffs and defendants when the business relationship ends in a dispute.
