The question of how best to protect non-functional 3D designs or design elements from an IP perspective is becoming increasingly important with the advent and rising popularity of 3D printing...In the United States and the European Union, such design aspects may be protected through copyrights, design patents (in the United States) or registered designs (elsewhere), trademarks/trade dress or, in some cases, a combination of these. Each of these forms of IP protection has certain advantages and disadvantages in terms of the degree of protection, cost, time to obtain, damages potentially available in the event of infringement and hurdles to proving such damages.
