    Often a patent assertion entity (PAE) (also known as patent trolls) will sue several competitors having products or services in the same market alleging infringement of the same patent(s). Although the America Invents Act (AIA) now forbids the filing of an omnibus infringement lawsuit against numerous operating companies in the same complaint alleging infringement of the same patent(s), PAEs are now filing multiple separate lawsuits in the same district against individual operating companies alleging infringement of the same patent(s). Counsel managing patent litigation in these scenarios must balance the benefits of proceeding alone with tailored defenses and litigation strategies against the efficiencies in cost and budget in leveraging a joint defense group with a defense and litigation strategy that may result in the lowest common denominator, while avoiding freeloaders and protecting competitive business interests.
