Summary

In 2013, I left the wonderful world of being a SALT consultant in public accounting to begin my solo career. I immediately began utilizing my almost 20 years of state tax experience and network of contacts to determine what that solo career would look like. My favorite part of working in the multistate taxation field has always been conducting research to answer complex questions and helping clients develop positions and support when the answers aren’t quite clear. Writing audit protests and memos, outlining and defending a client’s position is the type of work I find enjoyable – I like to call it – “research with a purpose.”

I also enjoy following the ever-changing world of multistate taxation on a daily basis and writing blog posts, articles, alerts, etc. attempting to explain complex matters in an easy-to-understand format while identifying the issues and potential action steps clients should take.

You might say that the initial steps of starting my solo career began back in 2009 when I started my state and local tax blog, “LEVERAGE SALT.” It was my creative outlet, my way to voice my thoughts, concerns, and ideas regarding multistate taxation. It was also my way of creating connections with CFOs, Controllers, and other tax professionals all across the country. (I am one of the first (if not the first) state and local tax blogs, now with over 700 posts on a variety of state tax topics).

I provide Fortune 500 and middle-market companies across the U.S. with a multistate tax resource not bound by independence restrictions or firm association, and without the overhead and large fees. I also work with CPA and law firms as an independent / subcontractor to provide them with an additional resource when needed.

The purpose of The Minnesota Tax Club is to connect Minnesota tax professionals, CFOs, Controllers, Tax Directors, accountants, attorneys, etc. Discussion topics included any tax topic, tax profession topic, etc.

Unlike other cities, such as Chicago, there appeared to be no "tax club" for Minnesota or Minneapolis.

I moved from Minnesota to Virginia in July, 2011, but still lead this group.

I successfully mitigated state tax risk, and identified state tax refund opportunities for private and public companies of various sizes. Projects included: nexus reviews, FAS 109 / FIN 48 state income tax provision reviews and analysis, state income tax modeling, NOL tracking, voluntary disclosure agreements, audit and notice dispute resolution, etc.

I also helped several clients conduct state tax planning around acquisitions, mergers and divestitures, and presented several state tax seminars for clients and internal personnel.

Sample Client Results:

While conducting a state income tax FIN 48 reserve analysis for a large middle-market company, identified over $1,000,000 in state income tax refund opportunities and $300,000 in prospective annual state income tax savings. These refund opportunities were identified in conjunction with the opportunity to utilize Voluntary Disclosure Agreements (VDAs) in multiple states to not only minimize the company's state income tax liability, but also reduce or eliminate the state income tax FIN 48 reserve.

Performed a state income tax nexus look-back review for a middle-market company, and identified $350,000 in refund opportunities and $100,000 in prospective annual state income tax savings.

Minneapolis Office State and Local Tax Leader

I served as the Minneapolis Office State and Local Tax Leader for Baker Tilly Virchow Krause, LLP. During my time there, I re-established the office's SALT practice, built strong working relationships with office partners, managers and staff, and successfully trained SALT staff. As a result, the office SALT practice became a strong performing part of the office and firm. I also strengthened the reputation of the SALT practice on a firmwide basis.

Sample Client Results:

Effectively represented and defended a corporation's position in regards to a Minnesota sales tax audit assessment (auditor assessed sales tax on what was perceived to be a "mixed-transaction" or "bundled transaction"). Prepared and filed written protest with the Minnesota appeals office resulting in the elimination of the entire $1,200,000 assessment.

Obtained $500,000 reduction in Washington D.C. sales tax audit assessment by effectively representing a corporate taxpayer who received a jeopardy assessment (reviewed audit assessment and identified opportunities to reduce assessment, formulated audit defense game plan and taxpayer positions, gathered necessary documents, prepared written protest which presented the taxpayer’s position and information in an effective manner).

Effectively represented and defended a Minnesota individual taxpayer in an income tax residency audit resulting in a $20,000 assessment; potential assessment was over $1 million.

Successfully obtained apportionment relief by petitioning for apportionment relief with appeals after
audit assessment was made. Reduced client's tax liability by 60%.

Performed in-depth “Amazon.com” nexus analysis for e-commerce retailer and created and implemented a state and local tax risk management plan.

Conducted research in eleven states for medical device manufacturer to determine sales and use tax taxability of device, and assisted in execution of plan to minimize exposure.

Senior State and Local Tax Manager

I was responsible for creating, building, and leading a new in-house state and local tax group, where prior attempts had failed.

I built infrastructure for the SALT group, including technical tools for regions, a SALT intranet site, and a monthly SALT Group newsletter providing technical updates to non-tax professionals throughout company. I also traveled to five regional operating companies and delivered presentations, building relationships and synergy.

Played a vital and integral role in implementing historic change within the culture and management of the company's tax department; changed reporting structure and redefined roles, resulting in improved people management and project management; making it a better place to work and reducing turnover;

Trained and developed inexperienced staff to not only learn, but also become a valued and reliable sales/use tax resource to the company. Developed strong mentoring relationships with staff, and was viewed as someone staff could confide in.

During my time at the company, I reduced initial state tax audit assessments from approx. $2 million to $500,000, and obtained $3 million in state tax credits/refunds.

Accounting Methods and Inventory (AMI) Technical Leader

I was responsible for providing technical guidance, audit defense and appeals representation/consulting on federal tax accounting issues with an emphasis in inventory methods, the timing of income and deductions, capitalization issues, depreciation methods, changes in methods of accounting and tax accounting period issues to all tax professionals throughout the firm and network firms.

I built a reputation as a strong and reliable tax technical accounting methods and inventory resource to RSM McGladrey (RSM) tax professionals and RSM Network firms throughout the country. Examples include: (1) Drafted IRS audit protest and successfully defended an office’s client in appeals re: IRC. 263A issues; (2) Drafted written explanation in response to an office’s client’s 21-day letter regarding their average cost inventory method and obtained approval from the IRS;

I built strong synergy with RSM offices throughout country resulting in a high-volume of work in National Tax by travelling to RSM offices, leading and developing Technical Advisory Group (TAG) monthly conference calls, writing weekly analysis of tax law developments for publication to RSM tax professionals and RSM network firms, and creating tax-efficient accounting method services.

I also authored RSM’s firm sponsored public comments on the IRS’ update to Rev. Proc. 2002-9 (2006), and prepared and collaborated with National Tax Leadership to implement strategic plan to grow Accounting Methods and Inventory services.
