Teaching law students a practical chapter 11 bankruptcy reorganization course. Students learn and discuss the reorganization process from pre-bankruptcy planning to commencement of a case through post-confirmation of a plan of reorganization. Among the topics covered are “first-day” motions and orders, the assumption or rejection of executory contracts, asset sales, and plan and disclosure statement issues. The course focuses and tracks a hypothetical bankruptcy cases that is based on real bankruptcy case, and the shifting and competing interests of parties to that Chapter 11 case are identified and explored. Students are taught both the techniques and strategies of Chapter 11 practice, as well as the history and philosophy of business rehabilitation. Students also are made aware of certain ethical issues that confront bankruptcy attorneys.
