Bonus Earned, Not Paid

Recruitment Consultant

Should the organization be paying the bonuses to the employees whose performance has been appraised but they are leaving right after the performance appraisal? If no, what can be the legal actions taken by the employee?

    If the employee has completed a certain performance apparaisal period and he / she is appraised well then the employee is entitled to for the concerned bonus.

    Bonuses earned for the services of previous year should be paid by the Company. In case not paid legal actions can be taken by the employee but in India that is a very long process and most of the time Companies win in this battle

    This is also a matter of reading the fine print within your contract however if the person has completed there service over the entire period then yes as a general rule the person is entitle for the bonus for that period.
