In June 2003, the company emerged from Chapter 11 protection as a private company, subsequent to its filing for bankruptcy under chapter 11 of the U.S. Bankruptcy Code in February 2003, with its creditor, Thomas Weisel Capital Partners, owning approximately 90% of the company's common equity.
