What type of legal requirements will an importer in India has to be aware of when importing products from China? i.e.- tariffs, customs and so forth? Thanks in advance!!

i presume that you have already registered a company and have all the registrations already completed.

get a proforma invoice and a sample of the product if possible. hand it over to a customs broker and find out what the customs department would require in the form of documentation from the other end. different products are governed by different rules. some products need certification prior to despatch.

also find out if there are any packing requirements. some packing material may not be allowed by the indian government.

find out if any labelling requirements need to be complied with. for many items you need labels on each item showing name of importer, date, max retail price etc etc. if this is not there then goods will get delayed and huge costs will be incurred for labelling within the port/CFS and demurrage would be charged.

also check with him what description and rate of duty would apply. you must note that the customs department is under no compulsion to accept this and could classify it differently at a higher rate of duty.

customs also could dispute the value of the goods and levy duty on the basis of a higher value.

clearing goods through indian customs could be quite a challenging job.
