FMLA - How will your company handle the recent law change?
For example: will you re-write your company's employee handbook now, or wait for further details? As luck would have it, our revised handbook was about to go to print when Bush signed this change. We're backing up to see what we want to add/modify.

The law went into effect as of the date it was signed - I think Jan. 28th. So employers need to comply immediately with the law as it is written. When the department of labor comes out with new regulations, you should compare the policy with the new regulations and update again if necessary. This can happen if the DOL regulations clarify a term or provision that the company interpreted differently.

We have analyzed the law and the Department of Labor comments, and are already been drafting new policies for our clients. The Department of Labor comments seem to indicate that, even before the regulations come out, employers should accommodate the leaves if people qualify. That's why we are suggesting that policies be modified.
